TTOs attempt to license new technologies as soon as possible, and especially during the one-year period of a “provisional” application. If no license is taken, or no significant interest shown, institutions sometimes abandon the application for a variety of reasons, including (1) minimizing legal and patent fees, (2) balancing technologies in the pipeline or (3) prioritizing based on budget constraints.
Rather than let a promising technology go abandoned, Bastille will arrange for an exclusive licensee. Wherever possible, Bastille works closely with Fish & Richardson to enhance the application and optimize its value.
